Terms


Ordering your cake


We do make every effort to meet all orders that we receive, however we are only able to make a finite number of cakes in any given week, and during the busy spring and summer months regrettably we may not be able to meet every request that we receive. We recommend that all orders are placed as early as is possible. The most common time period for orders to be placed is normally not less than 6 months before the wedding day especially in busy periods. You can use our save the date facility if you wish to be reminded that your date is becoming busy.

In the unlikely event that we have to cancel your order for any reason, then we will give you as much notice as possible, and discuss the matter with you and try to agree a suitable alternative. If you are not willing to accept our suggested alternative, then we will refund any monies paid to you.

Limitation of Liability: Except in respect of death or personal injury due to negligence for which no limit applies, our entire liability to you in respect of any claim whatsoever or breach of these Terms, whether or not arising out of negligence, shall be limited to the amount set out in the Order

In no event shall we become liable to you for any loss of business, loss of opportunity or loss of profits or for any other indirect or consequential loss or damage whatsoever. This shall apply even where such a loss was reasonably foreseeable or we had been made aware of the possibility of your incurring such a loss.


Paying for your cake

In order to secure a cake order we ask for a 20% non-refundable deposit. The balance is due no later than 21 days prior to the wedding date. For orders placed within one month of the wedding date, we do require full payment which is non-refundable. Please ask for details of our bank for direct transfers.


Changing your cake

Changes to your initial order can be made up to 6 weeks prior to your wedding cake being delivered, and should be made in writing, preferably via email. We will always acknowledge alterations sent to us by email. Where an alteration incurs a charge, you will be notified and the additional cost will be added to your final balance.


Cancelling your cake

If you wish to cancel your order more than 21 days prior to your delivery date, your deposit already paid is non-refundable. If you wish to cancel your order with less than 21 days before the delivery date, the full balance will be charged.


Delivering your cake

We aim to deliver every cake that we make to ensure that it is presented in the best possible way. We normally do not charge for deliveries made within 20 miles of St Albans, unless there are specific requirements that mean we incur additional costs. Deliveries outside of this area are charged at an hourly rate of 20 per hour based on distance and time of delivery. Once delivery to your venue is completed, we are not liable for any damage that occurs to your cake after we have left the premises.

In no event shall we be liable to you for any damage to your Order after Completion once it has been collected by you, or someone with control of your event or delivered to you or to someone with control of your event.

Force Majeure: Neither of us shall be liable for any delay or failure to perform any of our obligations if the delay or failure is caused by Force Majeure, The one affected by Force Majeure, shall be entitled to a reasonable extension of its obligations after notifying the other of the nature and extent of such events.

We can also supply cake stands. Our cake stands require a deposit if you wish to return them to us personally, or we can collect the stand from your venue. This collection service is charged at 20 per hour based on the distance and time of delivery.


General

Entire Agreement: These Terms embody the entire agreement between us and supersede all prior oral or written agreements, arrangements, or Orders. Unless expressly agreed otherwise, these Terms may only be varied by a document signed by both of us.

Waiver: A failure by either of us to enforce any one or more of these Terms shall not operate as a waiver of that term or of the right at any time subsequently to enforce all Terms of this agreement.

Exclusion Of Third Parties: Nothing in these Terms is intended to, nor shall it confer any rights on a third party, and the Contracts (Rights of Third Parties) Act 1999 shall not apply.
